RAUDE

Fraud is described as frustrating the public or a person of any property, money or valuable security or any service by deceit, falsehood or other fraudulent means. Among other things, it is exposing a person to the risk of economic prejudice through dishonest means.

It is not necessary for the accused to have benefited from the fraud nor that the fraudulent means employed lead to a real deprivation for the victim; it suffices that such acts risked causing a prejudice to his/her patrimony. If the value of the subject-matter of the offence exceeds $ 5,000, the maximum penalty is 14 years of imprisonment . Conversely, if the value of the subject-matter of the offence is less than 5 000$, the maximum penalty is 2 years of imprisonment.

THEFT

Theft consists of taking something that you have no right to, with the intention of depriving the owner of that thing. If the value of what is stolen exceeds 5 000$, the maximum penalty is 10 years of imprisonment. Conversely, if the value of what is stolen does not exceed 5 000$, the maximum penalty is 2 years of imprisonment.

CONCEALMENT

Concealment means to possess any object that comes from the commission of a criminal offense. The Crown attorney must prove the possession and knowledge of the accused of the unlawful provenance of the property. It is also a crime to traffic such objects, as is the possession of such property for the purpose of trafficking. The maximum term of imprisonment is 10 years if the property in question exceeds $ 5,000. Conversely, the maximum term of imprisonment is 2 years if the property in question does not exceed 5 000$.

FORGERY

Forging is the act of making a false document, which can be wholly or partly forged. The maximum penalty is ten years.

USE OF A FORGED DOCUMENT

The use of a forged document is when a person knowing or believing that a document is forged uses, deals with or acts on it as if it were genuine. It can also be when the person causes or attempts to cause any individual to use, deal with or act on it as if it were genuine. In such a case, the person is exposed to the same penalty as the person who made it.
