ARE YOU ACCUSED OF ASSAULT OR UTTERING THREATS?
ssault is when someone uses force on another person without his consent. There is no particular degree as to the strength involved. A simple touch with the hand can therefore be considered an assault. The application of force must be intentional. This is an offense of general intent; it is not necessary for one person to pursue a particular goal such as hurting, mutilating or humiliating another. A person commits an assault if he attempts or threatens to use force. He must be able to execute or at least reasonably let the other person believe that he is. The threat must be manifested by acts or gestures. It is not necessary that there be physical contact between the two people. For example, if you simulate an attack with your hand or an object, even without touching the person, this could be considered an assault. The person must have knowledge of the lack of consent of the other.
If the assault occurs in the context of a conjugal relationship, it is considered to be domestic violence. Domestic violence includes either assault or threats or both between spouses, whether you are married or not.
If you are charged with assault, several defenses are available to you. The most common being self-defence.
